Milsted Langdon on the Fair Work Agency's New Teeth

← The Journal

Our accountancy member sets out what tougher holiday pay enforcement from 2027 will mean for employers.

A useful early warning from No.20 member Milsted Langdon: from 2027, the new Fair Work Agency is expected to take a far more active hand in enforcing holiday pay, moving beyond a system that has long depended on workers bringing their own tribunal claims.

The firm's briefing sets out what is coming — powers to inspect records, issue notices of underpayment, and pursue tribunal proceedings on a worker's behalf, with the toughest measures reserved for serious or persistent breaches. Employers, it notes, have already had to keep six years of holiday pay records since April this year.

Sound, timely counsel of exactly the kind the firm is known for, delivered well before the deadline it describes.
