Our property member takes stock of the modernised Charities Act regime, and what it has taught trustees so far.
No.20 member Woottons has published a considered retrospective on the first full year of advised property disposals under the modernised Charities Act 2022 — the broadened surveyor's report, the simplified route for designated land, and marketing requirements now judged on reasonableness rather than a fixed checklist.
Its lesson for trustees is a patient one: the new regime has removed friction, not responsibility, and the paperwork that reads well a decade later is the paperwork done properly at the time. The full note is on the Woottons website.
